Who said anything about a "UPGRADE PACK"?

Even so, if the "original version PLUS the upgrade pack" is now covered
by the NEW EULA, you should be able to legally transfer the license(of
the entire SET) to a new machine or owner.

But Apple doesn't sell upgrades for it's OS.
(-: So the rest of this paragraph is mote. :-)

So it's the "big dongle" that you are really buying, the OS is just a
free add-on that comes with it, anyway.
